Tenant Terms & Conditions
These Tenant Terms & Conditions ("Tenant Terms") apply to all prospective tenants, applicants, and residents who interact with Bright Path Property Management ("Bright Path," "we," "us," or "our"), including but not limited to viewing properties, submitting rental applications, undergoing screening, signing leases, or occupying properties managed by Bright Path.
By submitting an inquiry, scheduling a showing, submitting an application, or entering into a lease for a property managed by Bright Path, you acknowledge and agree to the following terms.
1. Rental Applications & Screening
All rental applications are subject to screening and approval by the property owner. Bright Path facilitates the application and screening process but does not make final approval decisions.
Screening may include, but is not limited to:
- Credit history
- Criminal background checks
- Rental history verification
- Employment and income verification
- Identity verification
Submission of an application does not guarantee approval, nor does it create a lease agreement or right to occupy any property.
2. Application Fees
Application fees (if applicable) are:
- Non-refundable
- Used solely to cover the cost of third-party screening services
- Charged per applicant age 18 or older unless prohibited by law
Bright Path does not control or refund fees charged by third-party screening providers.
3. Credit Reports & Fair Credit Reporting Act (FCRA)
By submitting an application, you authorize Bright Path and its screening partners to obtain consumer reports for tenant screening purposes, consistent with the Fair Credit Reporting Act (15 U.S.C. ยง1681).
If your application is denied or conditionally approved based on information contained in a consumer report:
- You will receive an Adverse Action Notice
- The notice will identify the consumer reporting agency
- You have the right to request a free copy of your report and dispute inaccuracies directly with the reporting agency
Bright Path does not create or modify consumer report data and is not responsible for inaccuracies contained in third-party reports.
4. Fair Housing & Equal Opportunity
Bright Path is committed to strict compliance with all Fair Housing laws at the federal, state, and local level.
We do not discriminate on the basis of:
- Race or color
- Religion
- Sex
- Gender identity or sexual orientation
- National origin
- Familial status
- Disability
- Source of income (including housing assistance)
- Any other protected class under applicable law
All applicants are evaluated using consistent, objective screening criteria established by the property owner.
5. Showings & Property Access
Property showings may include:
- Agent-guided showings
- Self-guided showings using lockboxes or smart access systems
By attending a showing, you agree:
- To enter at your own risk
- To supervise any guests
- Not to disturb neighbors or current occupants
- Not to photograph or record interiors without permission
Bright Path is not responsible for personal injury, loss, or damage occurring during property showings except as required by law.
6. Lease Agreements
Bright Path acts as an agent for the property owner. All leases are between the tenant and the property owner, not Bright Path.
Lease terms, including:
- Rent amount
- Security deposit
- Lease duration
- Rules and policies
Are determined by the property owner and governed by the executed lease agreement and applicable law.
7. Security Deposits
Security deposits:
- Are held by the property owner (or as required by law)
- Are governed by state and local regulations
- Are not retained by Bright Path unless legally required
Bright Path does not determine deposit disposition and is not responsible for deposit refunds.
8. Maintenance & Repairs
During tenancy:
- Maintenance requests must be submitted through the designated Bright Path system
- Emergency issues should be reported immediately using provided emergency instructions
Bright Path coordinates repairs on behalf of the owner but does not guarantee timelines, vendor availability, or outcomes, and is not responsible for contractor workmanship.
9. Renter's Insurance
Tenants may be required to maintain renter's insurance as a condition of the lease.
Bright Path does not provide insurance coverage for tenants' personal property, liability, or living expenses.
10. Communication & Electronic Consent
By submitting your information, you consent to receive communications from Bright Path via:
- Phone calls
- Text messages
Communications may relate to:
- Showings
- Applications
- Lease processing
- Property updates
You may opt out of non-essential communications at any time. Message and data rates may apply.
11. Limitation of Liability
To the fullest extent permitted by law:
- Bright Path is not liable for damages arising from application decisions, lease disputes, property conditions, or owner actions
- Bright Path does not guarantee housing availability or approval
- Bright Path is not responsible for losses caused by third parties, owners, vendors, or other tenants
12. No Legal Advice
Bright Path is not a law firm and does not provide legal advice to tenants. Tenants are encouraged to consult independent legal counsel regarding lease terms or disputes.
13. Modifications
Bright Path may update these Tenant Terms at any time. Updated terms are effective upon posting to our website.
Continued interaction with Bright Path constitutes acceptance of any updated terms.
14. Governing Law
These Tenant Terms are governed by the laws of the state in which the property is located.
