2025 California Rental Law Updates
California continues to have some of the most tenant-friendly rental laws in the nation. Stay compliant with these critical updates affecting Southern California landlords in 2025.
Rent Control and Just Cause Eviction
AB 1482 (Tenant Protection Act) remains in effect, limiting annual rent increases to 5% plus local CPI (max 10%) for most properties. Just cause is required for evictions in covered properties. Know if your properties are exempt.
Security Deposit Limits
New legislation caps security deposits at one month's rent for unfurnished units, regardless of number of pets. Previously, landlords could charge up to two months' rent plus additional pet deposits.
Notice Requirements
Rent increases over 10% now require 90-day notice (previously 60 days). All rent increases require written notice, and the timing of notices must be precise to remain enforceable.
Habitability Standards
California's implied warranty of habitability is strictly enforced. Properties must meet minimum standards for weather protection, functioning plumbing/heating, and pest control. Failure to maintain habitability can result in rent withholding or "repair and deduct" actions.
Fair Housing Compliance
California fair housing laws extend beyond federal requirements. Discrimination based on source of income (including Section 8) is prohibited. Screening criteria must be consistently applied to all applicants.
Required Disclosures
Landlords must provide numerous disclosures including lead paint (pre-1978 properties), mold, pest control, and database information listings. Missing required disclosures can void lease provisions or result in penalties.
Documentation Requirements
Proper documentation is essential. Move-in/move-out inspections, repair records, and communication logs protect landlords in disputes. California courts favor tenants when documentation is inadequate.
